By downloading, installing, or using the OffCampus Housing mobile application or website ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

OffCampus Housing provides a platform connecting college students seeking housing with landlords offering rental properties near college campuses. We facilitate communication and transactions but are not a party to rental agreements between users.

3. User Accounts

Eligibility

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities under your account

Account Types

• Tenant Account: For students seeking housing
• Landlord Account: For property owners listing rentals
• Each user may maintain only one active account

4. Payment Terms

Payment Processing

• All payments are processed through Stripe, Inc.
• We do not store credit card information on our servers

Listing Fees (Landlords)

• Listing fees are charged per property listing
• Fees are non-refundable once a listing is published
• Current fees are displayed before payment confirmation

Saved Payment Methods

• You may save payment methods for faster checkout
• Saved cards use Stripe's PCI-compliant tokenization
• You can remove saved payment methods at any time
• Default payment method will be used for automatic charges

5. User Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate another person or entity
• Use the App for illegal purposes
• Harass, abuse, or harm other users
• Post discriminatory content
• Circumvent the App to avoid fees
• Attempt to gain unauthorized access to our systems
• Violate Fair Housing laws

6. Content and Listings

User Content

• You retain ownership of content you post
• You grant us a worldwide, non-exclusive license to use, display, and distribute your content
• You are responsible for the accuracy of your listings
• We may remove content that violates these Terms

Listing Guidelines

Listings must:

• Be for actual available properties
• Include accurate descriptions and photos
• Comply with Fair Housing laws
• Not contain discriminatory language
• Include truthful pricing information

7. Privacy and Data Protection

• We collect and use data as described in our Privacy Policy
• By using the App, you consent to our data practices
• We comply with applicable data protection laws including CCPA
• Payment processing meets PCI DSS standards
• Card data is encrypted and tokenized

• We may modify these Terms at any time
• Material changes will be notified via the App or email
• Continued use after changes constitutes acceptance
• We reserve the right to modify or discontinue the App
• We may change fees with 30 days notice

10. Termination

You may terminate your account at any time through account settings.

We may terminate or suspend accounts for:

• Violation of these Terms
• Illegal or fraudulent activity
• Extended inactivity
• Non-payment of fees

11. Fair Housing Compliance

All users must comply with Fair Housing laws. Discrimination based on race, color, religion, sex, national origin, familial status, or disability is prohibited.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit.
